User Agreement for AttendKor Mobile Application
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE ATTENDKOR MOBILE APPLICATION. BY USING THE ATTENDKOR MOBILE APPLICATION, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.
1. Definitions
1.1 "AttendKor" refers to the mobile application developed by Tejdhee Technologies, designed for teachers and students.
1.2 "User" refers to any individual or entity who uses the AttendKor mobile application.
2. Grant of License
2.1 Subject to the terms and conditions of this Agreement, Tejdhee Technologies grants the User a limited, non-exclusive, non-transferable license to use the AttendKor mobile application for its intended purpose.
2.2 The User may use AttendKor solely for personal or educational purposes and may not resell, sublicense, distribute, or transfer the application to any third party.
3. Attendance Tracking
3.1 AttendKor allows students to register their attendance automatically based on their location and biometrics and provides teachers with complete reports of the student’s attendance.
3.2 The User acknowledges that attendance tracking is dependent on the accuracy of location and biometric data provided by the User. Tejdhee Technologies shall not be liable for any inaccuracies or errors in the attendance data.
4. Intellectual Property
4.1 The AttendKor mobile application and all intellectual property rights associated with it, including but not limited to copyrights, trademarks, and trade secrets, are and shall remain the exclusive Intellectual Property of Tejdhee Technologies.
4.2 The User shall not modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to discover the source code of the AttendKor mobile application. Doing so by the user shall violate all the provisions of the said agreement and the previous agreements made.
5. Data Privacy and Security
5.1 The User acknowledges and agrees that Tejdhee Technologies may collect and process personal data as necessary for the operation and improvement of the AttendKor mobile application. The collection and use of personal data shall be governed by Tejdhee Technologies' Privacy Policy.
5.2 The User understands that AttendKor utilizes location and biometric data for attendance tracking purposes. Tejdhee Technologies shall implement reasonable security measures to protect the User's data; however, the User acknowledges that no method of transmission over the Internet or electronic storage is completely secure.
6. Limitation of Liability
6.1 Tejdhee Technologies shall not be liable for any damages, whether direct, indirect, incidental, consequential, or punitive, arising out of or in connection with the use of the AttendKor mobile application.
6.2 The User agrees to indemnify and hold Tejdhee Technologies harmless from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising out of or in connection with the User's use of the AttendKor mobile application.
7. Governing Law and Dispute Resolution
7.1 This Agreement shall be governed by and construed in accordance with the laws of India.
7.2 Any dispute or claim arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in [insert jurisdiction].
8. Amendments and Termination
8.1 Tejdhee Technologies reserves the right to amend or modify this Agreement at any time by providing notice to the User. The User's continued use of the AttendKor mobile application after such notice constitutes.
8.2 Tejdhee Technologies reserves the right to terminate this Agreement and revoke the User's access to the AttendKor mobile application at any time, with or without cause.
8.3 Upon termination of this Agreement, the User shall cease all use of the AttendKor mobile application and delete all copies of the application from their devices.
9. Severability If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
10. Entire Agreement This Agreement constitutes the entire agreement between Tejdhee Technologies and the User with respect to the use of the AttendKor mobile application and supersedes all prior or contemporaneous understandings and agreements, whether written or oral.
11. Waiver The failure of Tejdhee Technologies to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
12. Assignment The User may not assign or transfer any rights or obligations under this Agreement without the prior written consent of Tejdhee Technologies. Tejdhee Technologies may freely assign or transfer this Agreement without the User's consent.
13. Notices Any notices or communications required or permitted under this Agreement shall be in writing and sent to the addresses provided by the User during the registration process or as updated by the User in writing.
14. Survival Sections 4 (Intellectual Property), 5 (Data Privacy and Security), 6 (Limitation of Liability), 7 (Governing Law and Dispute Resolution), and 9 (Severability) shall survive any termination or expiration of this Agreement.
15. GZOD Content Networking Platform
15.1 The AttendKor mobile application includes a feature called GZOD Content Networking Platform ("GZOD"), which allows students and teachers to view, like, and dislike videos, images, and text posts.
15.2 The videos available on GZOD may be played through the application programming interface (API) of YouTube and may include videos from various content creators.
15.3 In addition to videos, GZOD may also include other types of posts, such as job postings, promotional content, and other relevant revenue-generation posts.
15.4 Tejdhee Technologies does not endorse or assume any responsibility for the content posted on GZO. The views and opinions expressed in such content are those of the respective users or content creators and do not necessarily reflect the views of Tejdhee Technologies.
15.5 The User acknowledges that they are solely responsible for their interaction with GZOD and the content posted therein. Tejdhee Technologies shall not be liable for any damages or losses arising out of or in connection with the use of GZOD or reliance on any content posted on GZOD.
15.6 Tejdhee Technologies reserves the right, in its sole discretion, to monitor, modify, or remove any content posted on GZOD that violates this Agreement or is deemed inappropriate or objectionable.
15.7 The User agrees not to use GZOD for any unlawful, harmful, or offensive purposes. The User shall not post any content that infringes upon the intellectual property rights of others, contains explicit or adult material, promotes violence, discrimination, or harassment, or violates any applicable laws or regulations.
15.8 By using GZOD, the User grants Tejdhee Technologies a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content posted on GZOD, solely for the purpose of operating and improving the AttendKor mobile application and its related services.
15.9 The User understands and agrees that Tejdhee Technologies may display advertisements or sponsored content on GZOD as part of the revenue generation efforts. The User acknowledges that such advertisements or sponsored content are not endorsements or recommendations by Tejdhee Technologies and that Tejdhee Technologies shall not be responsible for any interactions or transactions resulting from such advertisements or sponsored content.
15.10 Tejdhee Technologies reserves the right to modify, suspend, or terminate GZOD or any part thereof, at any time and without prior notice.
15.11 The User agrees to comply with any additional terms and guidelines provided by Tejdhee Technologies in relation to the use of GZOD, which may be updated from time to time. These clauses specifically address the GZOD Content Networking Platform on the AttendKor app, outlining the features, responsibilities, and guidelines associated with its usage.
